使用者服務條款 Terms of Service

「Whoscall 使用者服務條款(包含所有附加條款及後續更新版本)」涵蓋了 Whoscall 用戶適用的服務條款和條件(以下簡稱「本服務條款」)。Whoscall 的服務亦會受針對特定服務的服務條款(包括「Whoscall 象卡來市話版」服務條款、「Whoscall Number」服務條款)管轄。
“Whoscall Terms of Service” (including all attachments and subsequent updates) govern the terms and conditions applicable to users of the Whoscall service (hereinafter referred to as the “Terms”). Certain Whoscall services may also be subject to specific additional terms, including but not limited to the “Whoscall Landline Edition” and the “Whoscall Number” terms of service.

Whoscall 服務由走著瞧股份有限公司(以下簡稱「本公司」)提供,使用者下載本公司 Whoscall 應用程序(以下簡稱「Whoscall APP」)後,得以透過 Whoscall APP 享受各項服務(以下簡稱「本服務」)。
The Whoscall services (the “Services”) are provided by Gogolook Co., Ltd. (hereinafter the “Company”). Upon downloading the Whoscall application (the “Whoscall App”), users may access and use the Services via the App.

使用者使用本服務或註冊會員時,應先審閱、瞭解及同意本服務條款內容後,再於本服務應用程序或網頁上,就本服務條款點選「同意」(或類似文字)鍵。當您勾選同意或使用本服務,即表示您同意遵守本服務條款及本公司隱私權保護政策,您與本公司即成立商業契約關係,若您不同意接受本服務條款約束,請停止使用或會員申請程序或通知本公司註銷會員身分,本公司有權自行決定保留停止全部或部分之服務,以確保您的權益不受影響。本公司保有不定期更新、修改與補充本服務條款之權利。您應於註冊及/或使用本服務前仔細閱讀本服務條款之全部條款,並定期檢閱有關本服務條款之更新公告。
By registering as a member or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. By clicking “Agree” (or a similar confirmation) in the App or on our website, or by otherwise accessing or using the Services, you enter a legally binding contract with the Company. If you do not agree to these Terms, you should refrain from using the Services and may request cancellation of your membership. The Company reserves the right to suspend or discontinue all or part of the Services to protect your rights or the integrity of the platform.

The Company may update, amend, or supplement these Terms at any time. You are responsible for reviewing the latest version of the Terms before registering or using the Services and for periodically checking for updates.
一經註冊會員及/或下載、安裝、存取本服務,即表示您聲明並保證:
By registering and/or downloading, installing, or accessing the Services, you represent and warrant that:

  1. 您是具備完全權利能力和行為能力的自然人(如您為未成年人(七歲以上未滿十八歲之自然人)(或依您所在司法管轄區適用法律所規定之同等最低年齡),您已取得法定代理人之同意)、法人或其他組織,並已接受本服務條款,且依法有權為之。如您不具備前述主體資格,則您及您的法定代理人應承擔因此而導致的一切後果,且本公司有權註銷您的會員身分及/或停止向您提供本服務,並就本公司所受之任何損害及損失向您及您的法定代理人索賠;

    You are a natural person with full legal capacity and authority (or, if you are a minor aged 7 to under 18 (or the equivalent minimum age as required by the laws of the applicable jurisdiction), you have obtained consent from your legal guardian), or a legal entity or other organization with the legal right to enter into this agreement and to use the Services in accordance with applicable laws. If you do not meet these eligibility requirements, you and your legal representative will be held liable for any consequences, and the Company reserves the right to revoke your membership and/or suspend your access to the Services, and to seek compensation for any damages or losses incurred.

  2. 依照相關法規,您有權使用本服務;及

    You have the legal right to use the Services under applicable laws and regulations.

  3. 您提供予本公司之資料皆為真實且完整,並將依本公司之請求適時更新。

    The information you provide to the Company is true, accurate, and complete, and you agree to update such information as necessary upon request by the Company.

在您使用本服務或註冊會員前,本公司得要求您提供個人資料以進行身分確認。
Before registering or using the Services, the Company may require you to provide personal data for identity verification purposes.

第 2 條 定義 Definitions

本服務條款中之用詞定義如下:
For the purpose of these Terms, the following definitions shall apply:

  1. 使用者:係指使用本服務之自然人及政府機關及其他團體、行號或法人。

    User: Refers to any individual, government authority, organization, business, or legal entity utilizing the Services.

  2. 註冊用戶(或稱會員):係指已向本公司或本服務網站提供足以辨識個人身份之資料(包含但不限於電話號碼或電子郵件帳號),並完成註冊程序之使用者。

    Registered User (or Member): A user who has provided personally identifiable information (including but not limited to a phone number or email address) to the Company and completed the registration process.

  3. 非註冊用戶:係指使用本服務,但未提交足以辨識個人身份資料者。

    Unregistered User: A user who accesses the Services without submitting personally identifiable information.

  4. 試用會員:係指經由本服務提供之方案進行免費體驗(僅於限定期間內使用部分會員功能)。

    Trial Member: A user who accesses certain features of the Services free of charge and for a limited period as designated by the Company.

  5. 回饋性資料:係指使用者在使用本服務過程中因應不同功能或使用者本身需求所提供或產生的資料,包括但不限於聯絡人紀錄、封鎖紀錄、電話標記、查詢紀錄、回報資料(回報標籤、回報警示資料)以及使用者電話號碼相關聯資料,前述資料包含使用者本身資訊或其他非使用者資訊。

    Feedback Data: Refers to data generated or voluntarily submitted by users while using the Services in response to specific functions or needs, including but not limited to contact history, block logs, call labeling, search logs, report data (tags, alerts), and phone number-associated data. Such data may contain both user-related and third-party information.

  6. 第三方資料庫:係指由非本公司之第三方控制、管理或維護的公共或私有資料庫,本公司可能會取得該資料庫的使用權,並利用該資料提供服務給使用者。

    Third-Party Databases: Public or private databases operated by entities other than the Company. The Company may be granted access to such databases and utilize the data to provide Services to users.

  7. 搜尋引擎資料庫:係指由非公司之第三方控制、管理或維護的公開網路搜尋引擎,本公司可能會利用透過該搜尋引擎所取得的公開資料,為使用者提供相關服務。

    Search Engine Databases: Public web search services managed by third parties. The Company may use publicly accessible data obtained via such engines to deliver related Services to users.

  8. 去識別化:係指透過技術處理,讓資料於不再另外取得其他資料的情況下,無法直接識別出特定個人,並確保任何可以重新識別個人的附加資訊,都已經分開儲存,並採適當安全措施防止重新識別的可能性。

    Pseudonymization/Anonymization: A technical process whereby data cannot, without the use of additional information, be attributed to a specific individual. Any information capable of re-identifying a person is stored separately and safeguarded by appropriate technical and organizational measures to prevent re-identification.

第 3 條 使用者類型及會員制度 User Categories and Membership

  1. 本服務原則上開放非註冊用戶於未經註冊或登入之情況下使用部分功能。惟如需使用特定進階功能,使用者需註冊成為本服務會員。會員得依其所選方案區分為正式會員或試用會員,前者係經完成付費程序者,後者則係經申請試用並於試用期間內使用本服務者。

    The Services are partially accessible to unregistered users without login. However, access to advanced features requires user registration. Registered users may be categorized as paid members or trial members. Paid membership requires payment processing, while trial membership allows temporary access as provided by the Company.

  2. 不同使用者類型可使用之服務範圍、功能及權益,將依本公司公告內容為準,建議您於使用前詳閱各項服務說明。

    The scope of access, features, and user entitlements will be as announced by the Company. Users are advised to consult such documentation before using the Services.

  3. 不同使用者得透過本公司客服申請終止使用本服務或會員身分,本公司亦保留完整審核、暫停或終止會員資格之權利。

    Users may request termination of their membership or access rights via customer service. The Company reserves the right to review, suspend, or terminate membership at its sole discretion.

第 4 條 同意事項 User Consent and Grant of Rights

  1. 本服務旨在協助使用者辨識來電、管理聯絡人資料、阻擋垃圾電話及詐騙電話等,並提供相關的附加功能以增強使用者體驗。此服務包括但不限於以下附加功能:

    The Services are designed to help users identify incoming calls, manage contact information, block spam or fraudulent calls, and enhance the overall communication experience. This includes supplementary features such as:

    1. 網站檢查:當使用者啟用此功能後,本服務將根據使用者選擇的方式,取得使用者訪問的網站/伺服器網域,並運用內部資料庫檢查該網域的潛在風險,並提供相應提醒。

      Website Check: When enabled, the Service may collect and assess the domain of websites visited by the user to evaluate associated risks using the Company's internal database and provide relevant alerts.

    2. 防詐快訊:本服務會定期向使用者提供防詐警示訊息,這些訊息由本公司自行創作或與他人合作創作,旨在提高使用者對防詐騙的警覺性,並提供最新的防詐訊息與研究報告。

      Fraud Alerts: The Service may periodically provide users with security notifications related to fraud prevention. These alerts are generated by the Company or in cooperation with third parties, aiming to increase user awareness and share recent insights or research.

  2. 使用者經由本服務提供之資料(包括但不限於封鎖紀錄、電話標記、紀錄查詢、聯絡人備份/收藏、網站查詢紀錄、圖片、風險判定等),其所有權仍屬於您。您同意無償及永久授權本公司於全球範圍內,且得以可轉授權、可再轉讓之方式,利用前述資料(包括但不限於進行儲存、分析、統計、展示或開發衍生應用)。

    Users retain ownership over data they provide through the Service (including block lists, call labels, search logs, contact backups, risk flags, and associated visuals). By using the Service, users grant the Company a worldwide, royalty-free, perpetual, transferable, and sublicensable license to use such data for purposes including storage, analysis, statistical modeling, display, and development of derivative services.

  3. 使用者同意其主動提供之回饋性資料係自願提供,本公司無義務將該資料予以採納或回應,且本公司得自由地無償利用該等回饋性資料(包括但不限於重製、修改、改作、散布、銷售、展示、發行及以其他方式利用該等回饋性資料)。

    Users acknowledge and agree that the submission of feedback data is voluntary, and the Company is under no obligation to adopt or respond to such data. The Company is entitled to use such feedback data freely and without charge, including but not limited to reproduction, adaptation, distribution, public communication, and commercialization.

  4. 使用者瞭解並同意,就前開資料,本公司的基於以下目的,進行儲存、分析、處理或統計或其他利用:

    The User acknowledges and agrees that the Company may store, analyze, process, or statistically utilize the aforementioned data for the following purposes:

    1. 提供用戶個人化之功能與服務體驗;

      To provide personalized features and enhance the user experience;

    2. 優化系統效能與資料精確度;

      To optimize system performance and improve data accuracy;

    3. 開發及提升本公司服務;

      To develop and enhance the Company’s services;

    4. 進行內部之風險評估與安全分析;

      To conduct internal risk assessments and security analysis;

    5. 經營本服務或本公司其他業務。

      To operate the Services or other business activities of the Company.

  5. 為提供使用者本服務,本公司將依使用者操作,查詢本公司資料庫、第三方資料來源及搜尋公開資訊等方式,並將查詢結果(包括但不限於號碼或並將查詢結果(如該號碼或網域之名稱、來源、風險判定結果等)回傳供使用者參考。使用者同意,在提供此等服務時,本公司得使用其裝置上已儲存的聯絡人資訊、網域資訊、瀏覽紀錄,以協助提升電話號碼資訊的個人化辨識與判斷準確性。本公司對於前述資料之使用,應依資料去識別化、匿名化或加密方式處理,並遵守相關法規。

    To provide the Services, the Company may query its own databases, third-party data sources, and publicly available information retrieved through search engines. Query results, including but not limited to telephone numbers, domain names, sources, and risk classification results may be returned for your reference.

    You agree that, in providing the Services, the Company may access contact information, domain data, and browsing history stored on your device to enhance the accuracy and personalization of caller identification. The Company shall process such data in a pseudonymized, anonymized, or encrypted manner and in accordance with applicable laws.

  6. 在法規許可範圍內,您同意本公司得使用您的個人資料經營本公司業務;

    To the extent permitted by law, you consent to the Company using your personal data for the purpose of operating and managing its business.

  7. 使用者同意本公司得於法令許可特定目的範圍內,依據本公司之隱私權保護政策,自行或委託第三人處理、利用及儲存個人資料。

    You agree that the Company may, for specific purposes permitted by law and in accordance with its Privacy Policy, process, use, and store your personal data directly or through authorized third parties.

  8. 使用者同意本公司為維護公共利益、強化資安風險控管、防制詐騙、防制洗錢或其他涉國家安全等考量,得依法令許可範圍內,提供資料予警察機關、行政機關、司法機關、其他具調查權利或合法主張之機關。

    You further consent that, for the purposes of safeguarding public interest, enhancing cybersecurity, fraud prevention, anti-money laundering, or protecting national security, the Company may provide your data to law enforcement authorities, administrative agencies, judicial authorities, or other bodies with legal investigatory powers, to the extent permitted by applicable law.

第 5 條 會員使用說明 Membership Use and Responsibilities

  1. 使用者註冊成為本服務會員時,亦已瞭解並將遵守本條提及之義務:

    By registering as a member, you understand and agree to the following obligations:

    1. 個人資料之提供:使用者同意提供完整且真實之個人資料(包括但不限於電話號碼、姓名以及其他與註冊相關之資訊)予本公司及受本公司依法委任處理事項之第三方,並同意本公司就該個人資料為蒐集、處理或利用,得依查詢及回報之結果,採取任何合理措施。

      Provision of Personal Data: You agree to provide complete and accurate personal information, including but not limited to your phone number, name, and other registration-related data, to the Company or its lawfully appointed processors. You authorize the Company to collect, process, and use such personal data, and to take any reasonable measures based on the results of internal or user-generated queries or reports.

    2. 帳號安全維護:Account Security:

      1. 為了完整使用會員功能,使用者同意在使用本服務前及使用本服務期間需進行會員登入。使用者並依合理方式妥善保管帳號授權碼,不得以暗示、透露帳號授權碼、讓渡、出借或授權第三人使用會員帳號。使用者同意本公司得於偵測帳號於多隻手機裝置上登入時,得逕行強制登出所有已登入之帳號。

        To access full membership features, you agree to log in prior to using the Services and maintain active authentication during use. You must safeguard your login credentials and shall not imply, disclose, transfer, lend, or authorize any third party to access your account. The Company reserves the right to forcibly log out accounts that are detected as logged into multiple mobile devices simultaneously.

      2. 使用者瞭解並同意,在帳號被強制登出後,需再次登入。您同意,在此過程中如有任何損失,本公司不負任何損失賠償責任。

        In the event of a forced logout, you agree to reauthenticate, and you acknowledge that the Company bears no liability for any losses resulting from this process.

    3. 即時回報:如使用者發現自己的帳號遭到入侵或有可能遭到入侵,應立即變更密碼並通知本公司客服,本公司將檢視相關情形,並保留暫停相關帳號之權利,以助於釐清帳號使用問題後,重新設定並開通帳號使用。

      Incident Reporting: If you discover or suspect that your account has been compromised or accessed without authorization, you must immediately change your password and notify the Company’s customer service. The Company reserves the right to suspend the account during investigation and assist in reactivating access upon resolution.

    4. 風險負擔:使用者瞭解並同意本服務未保證完整性、準確性,使用者應自負審查之義務,確保本服務僅為使用者決定時的參考依據之一。同時,使用者應理解一切帳號均推定為使用者本人進行,故將由帳號所有人負擔一切法律責任。

      Risk and Liability: You understand and agree that the Services do not guarantee completeness or accuracy. You are solely responsible for independently verifying information retrieved from the Services and for any decisions made based on such information. All actions performed through your account are presumed to be conducted by you; accordingly, you shall bear full legal liability for such activities.

    5. 合規義務:使用者不得非法利用本服務,亦不得提供帳號資料或蓄意利用本服務於非法用途,如有違反,應負法律責任。

      Compliance Obligations: You shall not use the Services for any unlawful purposes, nor may you provide false account information or intentionally use the Services for illegal activities. You shall bear legal responsibility for any such violations.

    6. 負擔費用:使用者瞭解會員享有與一般使用者不同之服務內容,並同意本公司就所訂閱或購買之服務收取相對應費用,請點選:https://whoscall.com/zh-hant/premium(以了解服務內容及費用等說明)。

      Payment and Fees: You understands that members are entitled to services that differ from those provided to general users and agrees that the Company may charge corresponding fees for the services subscribed to or purchased.     7. 賠償責任:如使用者因下列情事而致本公司受有任何損失或損害,本公司並得向您請求損害賠償(包含但不限於訴訟費用、律師費及商譽損失):

      Indemnity: The User shall indemnify the Company for any losses or damages (including but not limited to legal fees, attorney's fees, and reputational harm) caused by:

      1. 違反本服務條款 Breach of these Terms of Service;
      2. 使用或錯誤使用本服務;及/或 Use or misuse of the Services; and/or
      3. 違反任何相關法規。 Violation of applicable laws or regulations
  2. 試用會員 Trial Membership

    1. 本公司可能免費提供序號予使用者試用本服務,使用者需依序號卡、序號購買頁面指示完成啟用。試用資格於序號啟用時(依本公司後台系統記載)起算,並開始享有顯示期間內之使用權益。

      The Company may offer Users free trial access to the Services through the provision of an activation code. Users must follow the instructions on the activation card or on the designated purchase page to complete the activation process. The trial period shall commence from the time the activation code is recorded as active in the Company’s backend system, and the User shall be entitled to the use of trial features within the designated validity period.

    2. 依據使用者輸入之序號不同,會員功能開通或有部分不適用的可能(實際功能依本公司公告為準)。

      Depending on the activation code entered, certain membership features may be restricted or unavailable. The actual scope of features shall be subject to the latest announcements issued by the Company.

    3. 試用會員相關權益於序號期滿後即自動終止,本公司不另行通知。

      All trial rights and privileges shall automatically expire at the end of the trial period without prior notice from the Company.

    4. 試用序號原則上經開通後不得轉讓,不得重複啟用及以其他不當方式取得;如經判斷有異常使用情形,本公司保留逕行終止帳號使用或取消使用的資格。

      Once activated, a trial code is non-transferable and may not be reused or obtained through unauthorized means. If the Company determines that the trial account has been misused, it reserves the right to suspend the account or revoke access without prior notice.

    5. 試用期間所留存於本服務之資料不提供轉移、備份或保證保存;本公司亦不對試用期間之服務穩定性、可用性或完整性負任何保證責任。

      Data stored during the trial period will not be supported for transfer, backup, or guaranteed retention. The Company does not provide any warranties with respect to the stability, availability, or integrity of the Service during the trial period.

    6. 試用期間屆滿後,若使用者欲繼續使用相關會員功能,需自行依本公司提供之方式訂閱或啟用正式會員方案。

      Upon expiration of the trial period, Users who wish to continue using member-only functions must subscribe to or activate a full membership plan in accordance with the method provided by the Company.

第 6 條 服務暫停或終止 Suspension or Termination of Services

  1. 使用者如有違反本服務條款之約定,本公司有權拒絕或暫停提供本服務,包括但不限於拒絕或暫停或終止本服務及/或凍結會員帳戶,且使用者應承擔所有相關法律責任。若因此造成本公司、本公司代表人、本公司員工之損害或支出費用或受第三人主張權利,使用者同意負擔賠償及補償責任(包括合理之律師費)。

    If the User violates any provision of these Terms of Service, the Company reserves the right to refuse, suspend, or terminate access to all or part of the Services, including freezing of the User’s account. The User shall bear full legal responsibility for such breach.
    In the event the Company, its representatives, or employees incur any loss, damage, or are subject to claims by third parties as a result of the User's actions, the User agrees to indemnify and compensate the Company (including for reasonable attorney’s fees).

  2. 如有下列情形之一者,本公司得依情節輕重,終止或暫停其使用本服務之全部或一部及/或凍結會員帳戶,本公司保留不另行通知之權利:

    The Company reserves the right to suspend or terminate all or part of the User’s access to the Services, or freeze the User’s account without prior notice, based on the severity of the circumstances, including but not limited to the following:

    1. 有相當事證足認使用者利用本服務從事不法行為或疑似該等不法行為者。There is reasonable evidence that the User has used the Services for or in connection with unlawful conduct, or is suspected of doing so;

    2. 當使用者違反本服務條款,不當使用本服務,致影響系統安全、損害其他使用者權益或其他侵害本公司權益之行 The User has violated these Terms, misused the Services, or taken actions that endanger system security, infringe on the rights of other users, or harm the Company’s interests;

    3. 本公司依據相關政策、業務調整、第三方關係變動或主管機關要求,認為有必要終止或調整本服務內容。The Company deems it necessary to modify or terminate the Services due to internal policy adjustments, changes in third-party partnerships, or regulatory requirements;

    4. 使用者帳號不當使用、經多次登入異常情形,經本公司合理判斷有資安風險者。The User's account exhibits unusual login activity or unauthorized use, indicating a cybersecurity risk as reasonably determined by the Company.

  3. 若因上述原因導致無法繼續使用服務,本公司不負任何直接或間接之損害賠償義務;亦無須退還終止前所支付之任何費用。

    In such cases, the Company shall not be liable for any direct or indirect damages arising from the suspension or termination, and shall not be obligated to refund any fees paid prior to such action.

  4. 使用者得隨時透過 Whoscall APP 內設定功能或依本公司公告方式提出終止帳號申請。

    The User may terminate their account at any time through the settings function within the Whoscall App or by following the procedures announced by the Company.

  5. 付費會員(非終身版訂閱者)可申請停止自動續訂,其會員權益將於既有期間屆滿後終止;於屆滿前期間內,使用者仍得依原服務內容正常使用,惟不另行退還未完期間之費用。

    Paid members (excluding lifetime subscribers) may cancel automatic renewal. In such cases, membership benefits will terminate at the end of the current billing cycle. During the remaining subscription period, the User shall continue to enjoy access to the Services but shall not be entitled to a refund for unused time.

  6. 使用者申請終止或自行從裝置刪除 Whoscall APP,本公司基於法令遵循、權益維護、資安改善、服務改善或資料備援等合理目的,仍可能保留適用於服務期間內所提供或產生之部分或全部資料,保存期間將依據本公司隱私權保護政策及適用法令辦理。

    If the User terminates their account or deletes the Whoscall App, the Company may retain some or all data provided or generated during the subscription period for purposes such as legal compliance, safeguarding user rights, improving information security, service enhancements, or maintaining data backups. Data retention shall be handled in accordance with the Company’s Privacy Policy and applicable laws.

  7. 本公司另得基於下列原因而暫停提供本服務之一部或全部:

    The Company may suspend all or part of the Services for the following reasons:

    1. 本公司對本服務之系統進行預訂之維護、搬遷、升級或保養,應於七日前,於本服務網頁或 Whoscall APP 推播公告,並依雙方約定方式通知使用者。但有緊急情事者,不在此限。

      System maintenance, relocation, upgrades, or repair. In such cases, the Company shall provide notice at least seven (7) days in advance via the Services webpage or app notification, unless emergency circumstances apply;

    2. 其他不可歸責於本公司之事由,如天災、停電、設備故障、第三人之行為。

      Causes not attributable to the Company, including but not limited to natural disasters, power outages, hardware failure, or third-party misconduct.

    3. 本服務條款另有約定之事項。

      Any matters not covered under this clause shall be governed by the remaining provisions of these Terms.

第 7 條 禁止行為 Prohibited Conduct

  1. 使用者使用本服務時,應符合本服務所預設之目的,不得違反本服務條款、法律、公序良俗、侵害本公司或第三人合法權益、或涉有未經主管機關核准及其他法規禁止或主管機關不能從事之交易。上述行為包括但不限於:

    While using the Services, the User shall comply with the intended purposes of the Services and shall not engage in any act that violates these Terms, applicable laws and regulations, public order or good morals, or that infringes upon the legitimate rights or interests of the Company or any third party. The following behaviors are strictly prohibited, including but not limited to:

    1. 侵害他人財產權、名譽權、隱私權、營業秘密、商標權、著作權、專利權等合法權益。

      Infringing upon the intellectual property rights, reputational rights, privacy, trade secrets, trademarks, copyrights, patents, or other lawful interests of others;

    2. 違反法定或約定之保密義務。

      Violating statutory or contractual confidentiality obligations;

    3. 冒用他人名義或他人帳號密碼使用本服務。

      Impersonating others or using another person’s account or credentials to access the Services;

    4. 從事不法交易行為,如洗錢、販賣槍枝、毒品、禁藥、盜版軟體及其他法令所禁止之交易。

      Engaging in illegal transactions, including money laundering, trafficking in firearms, narcotics, controlled substances, pirated software, or other transactions prohibited by law;

    5. 從事任何侵害本服務系統或資料之行為。

      Accessing or interfering with the Company’s systems or data in an unauthorized manner;

    6. 未經授權,進入、干擾或使用本公司或其合作夥伴的非公開系統。

      Accessing, disrupting, or using non-public systems belonging to the Company or its partners without authorization;

    7. 任何由本公司提供的會員資格、序號、優惠碼或其他付費服務項目,僅限於本人合法取得後自行使用,不得轉讓、兜售或透過拍賣、論壇、社群平台等方式散布或販售。

      Transferring, selling, auctioning, or distributing membership accounts, activation codes, discount codes, or other paid service items in any unauthorized manner, including via online forums or social media platforms;

    8. 上傳、發布或傳送任何具有下列性質的內容:

      Uploading, posting, or transmitting any content that:

      1. 虛假、不實或具誤導性的資訊 Contains false, misleading, or deceptive information;
      2. 誹謗、冒犯或侵害他人隱私 Is defamatory, offensive, or invasive of others’ privacy;
      3. 淫穢、色情、具攻擊性或令人不適的內容 Is obscene, sexually explicit, offensive, or disturbing;
      4. 散播偏見、仇恨、歧視或可能對個人或團體造成傷害 Spreads prejudice, hatred, discrimination, or is likely to harm individuals or groups;
    9. 試圖掃描、探測或測試本服務的系統或網路漏洞,或規避安全機制。

      Attempting to scan, probe, or test the vulnerability of the Service’s systems or network, or bypassing security mechanism.

    10. 偽造任何識別資訊,或以其他方式傳送錯誤、虛假的來源資料。

      Forging identifying information or otherwise transmitting false or misleading origin data

    11. 對用於提供本服務的軟體進行破解、還原、反向工程、反編譯或以其他方式取得原始碼,或以機器人帳戶或其他技術方法,變更、刪除、破壞本服務之資料、內容或設備,或對本公司之經營造成不良影響。

      Reverse engineering, decompiling, or otherwise attempting to derive source code of the software used in the Services, or using automated tools (e.g., bots) to manipulate or destroy data or content within the Services.

    12. 修改、散布、轉讓、轉租或未經授權提供 Whoscall APP 給第三人使用,包括將 Whoscall APP 功能提供給他人使用。

      Modifying, distributing, subleasing, or making unauthorized copies of the Whoscall APP, including providing access to its functionalities to third parties.

    13. 冒用他人身分或對您與他人/公司間的關係作出不實陳述。

      Impersonating another individual or falsely representing your relationship with any person or entity.

    14. 藉由本服務設計存在之漏洞,或以越過、破壞安全維護機制等其他技術方法,變更、刪除或蒐集他人之個人資料;

      Exploiting security vulnerabilities or bypassing protection mechanisms to alter, delete, or collect the personal data of others.

  2. 使用者如有違反前項約定,本公司有權拒絕或暫停提供本服務,包括但不限於暫停帳號權限或終止本服務及/或凍結會員帳戶,且使用者應自行承擔所有相關法律責任。若因此造成本公司、本公司代表人、本公司員工之損害或支出費用或受第三人主張權利,使用者負擔賠償及補償責任(包括合理之律師費)。

    If the User is found to have engaged in any of the prohibited activities described above, the Company reserves the right to refuse, suspend, or terminate access to the Services, freeze the User’s account, and pursue all legal remedies available. The User shall bear all resulting legal responsibilities. If the Company, its representatives, or employees suffer any losses, incur expenses, or are subject to third-party claims as a result, the User agrees to indemnify and compensate the Company, including for reasonable legal fees.

  3. 除上述,本公司可能依情節輕重採取下列處理方式,包括但不限於:

    In addition to the above, the Company may take any of the following actions based on the severity of the violation, including but not limited to:

    1. 刪除違規內容 Removing offending content;

    2. 保留法律追訴權利,並依法向主管機關或執法機關通報 Retaining the right to initiate legal proceedings or report the matter to regulatory or law enforcement authorities。

  4. 本公司不主動監控所有使用行為,惟若本公司認為有必要為了維護服務安全、使用體驗或依法配合主管機關命令時,仍保留作取相應措施之所有權利。

    The Company does not actively monitor all user behavior. However, it reserves the right to take any necessary actions, including suspending services or providing information to authorities, if required for service security, user protection, or compliance with legal orders.

第 8 條 授權下載 License and Download

  1. 本公司授予使用者一項非專屬、不可轉讓、不得再授權且僅限個人、非商業用途之有限授權,使使用者得依據本服務條款使用 Whoscall APP;使用者不得將本服務用於任何未經授權之目的,包括但不限於商業銷售、轉售或其他牟利行為。

    The Company grants the User a limited, non-exclusive, non-transferable, non-sublicensable license to download and use the Whoscall APP solely for personal, non-commercial purposes and strictly in accordance with these Terms of Service.

    The User shall not use the Services for any unauthorized purposes, including but not limited to commercial sale, resale, or any other activity intended for financial gain. Any attempt to copy, distribute, modify, sublicense, or otherwise exploit the App or any component thereof in violation of this license is strictly prohibited and may result in legal liability.

第 9 條 資訊安全系統、控管、責任 Information Security, System Management, and Responsibilities

  1. 本公司辦理本服務之資訊系統標準及安全控管作業基準,均符合 ISO27701 及 ISO27001(以下簡稱「資安標準」)之規定。

    The Company has obtained ISO 27001 certification and is committed to continuously strengthening its data protection mechanisms and internal management systems to protect user rights. While the Company endeavors to safeguard data security, it does not guarantee the absolute integrity, availability, or accuracy of the Services or any data transmitted via the Services.

  2. 當發生身分認證資訊錯誤時,本公司系統應依前項規定自動停止使用者使用本服務。使用者如擬恢復使用,應依約定辦理相關手續。

    In the event of identity authentication errors, the Company's system shall automatically suspend the User's access to the Services in accordance with the foregoing standards. To resume usage, the User must complete the designated reinstatement procedures.

  3. 本公司及使用者均有義務確保所使用資訊系統之安全,防止非法進入系統、竊取、竄改、毀損業務紀錄或使用者個人資料。

    Both the Company and the User are obligated to ensure the security of their respective information systems, and to prevent unauthorized access, data theft, tampering, destruction of business records, or compromise of personal data.

  4. 本公司資訊系統之保護措施或資訊系統之漏洞所生爭議,由本公司就該事實不存在負舉證責任。如有不可歸責於使用者之事由者,由本公司承擔相關責任。

    In the event of any dispute arising from system vulnerabilities or the effectiveness of protective measures, the Company bears the burden of proof to demonstrate the nonexistence of such defects. If the incident is not attributable to the User, the Company shall assume responsibility.

  5. 使用者對本服務所提供之帳號、密碼、憑證或其他足以辨別身分之工具負有妥善保管之義務,不得以任何方式讓與或轉借他人使用。

    The User is responsible for the secure custody of account credentials, passwords, authentication tokens, or any identity-related tools provided through the Services, and shall not assign or lend them to any third party under any circumstances.

  6. 本公司或使用者於發現第三人冒用或盜用使用者持有之本服務帳號、密碼或憑證等資料,或有其他任何未經合法授權之情形時,應立即以雙方約定之方式通知他方停止本服務並採取防範措施。

    Upon discovering any unauthorized or fraudulent use of a User’s account, password, or credentials by a third party, or any other unauthorized access, the Company or the User shall immediately notify the other party in the agreed manner and take appropriate preventive measures.

  7. 本公司應於本服務網頁明顯處,載明使用者帳號、密碼等資料被冒用、盜用或發生其他任何未經合法授權時之通知方式,包含電子郵件信箱等資訊,除有不可抗力或其他重大事由,受理通知之服務時間應為全日全年無休。

    The Company shall clearly publish on the Services website the notification channels email, for reporting unauthorized use or compromise of user credentials. Except in cases of force majeure or other material causes, the reporting service shall be available 24/7.

  8. 使用者同意於使用本服務時,本公司得就使用者登入資訊(包括網路 IP 位置與時間)、所為之行為及其他依法令應留存之紀錄予以詳實記錄。

    The User agrees that, while using the Services, the Company may log and retain detailed records of user login information (including IP address and timestamp), user actions, and any other data that must be retained pursuant to applicable laws.

第 10 條 廣告及其他行銷內容 Advertising and Other Marketing Content

  1. 使用者瞭解為了永續經營,本公司接受廣告業務,並同意在使用本服務時接受廣告和其他行銷內容。

    The User acknowledges that, for the purpose of sustaining business operations, the Company accepts advertising services and agrees to receive advertisements and other marketing content while using the Services.

  2. 本公司將使用經合法取得或由使用者主動提供之黃頁資料,並依服務類別、地理區域、使用習慣、消費水準等進行分類,以提供使用者可能感興趣之廣告內容。

    The Company may use legally obtained yellow pages data or data voluntarily provided by the User, and categorize such data based on service category, geographic region, usage behavior, and consumer profile to deliver advertisements that may be of interest to the User.

  3. 為提升廣告品質與避免干擾,使用者同意本公司得基於合法目的,蒐集、分析並使用您經去識別化後的服務使用紀錄,並進行個人化廣告推播,包括但不限於以下用途:

    To enhance advertising quality and minimize disruption, the User agrees that the Company may, for legitimate purposes, collect, analyze, and use de-identified usage records to deliver personalized advertising. This may include, but is not limited to, the following purposes:

    1. 減少重複接收相同廣告內容;
      Reducing repeated exposure to the same advertisement;

    2. 偵測並排除不當廣告內容;
      Detecting and excluding inappropriate advertising content;

    3. 優化廣告與使用行為之關聯性。
      Optimizing the relevance between advertisements and user behavior.

第 11 條 紀錄保存 Record Retention

  1. 為保障本服務安全、提升服務品質及依遵循相關法令要求,使用者理解並同意本公司得保存使用者使用本服務之相關紀錄,包括但不限於帳號與裝置資訊(登入時間、手機作業系統類型、裝置識別碼)、操作紀錄(查詢紀錄、回報紀錄、服務互動行為)、交易及授權紀錄(購買紀錄、序號兌換、付款時間及授權狀態)、系統紀錄(錯誤紀錄、登入失敗紀錄、異常操作警示紀錄)。

    To ensure the security of the Services, enhance service quality, and comply with applicable legal obligations, the User understands and agrees that the Company may retain records related to the User’s use of the Services. Such records may include, but are not limited to Account and device information (e.g., login timestamps, mobile OS type, device identifiers); Usage logs (e.g., query history, report records, interaction behavior); Transaction and authorization records (e.g., purchase history, code redemption, payment timestamps, authorization status); System logs (e.g., error logs, failed login attempts, abnormal operation alerts).

  2. 本公司保存上開資訊的目的包括但不限於:

    The purposes of retaining the above-mentioned information include, but are not limited to:

    1. 認證與驗證使用者身分;

      Authenticating and verifying the User’s identity;

    2. 處理客服需求或爭議事件;

      Handling customer service requests or dispute resolution;

    3. 分析服務使用行為以優化功能;

      Analyzing service usage behavior to optimize functionality;

    4. 防範惡意行為或違反本服務條款之行為;

      Preventing malicious conduct or violations of these Terms;

    5. 配合法令或主管機關要求。

      Complying with legal obligations or requests from competent authorities.

  3. 本公司將依內部資訊安全政策對上述資料保存、加密、限權使用,並僅限於達成前述目的範圍內處理,並依不同類型資料設定合理保存期限,期限屆滿後刪除或匿名化處理,法令另有規定者不在此限。

    The Company shall store, encrypt, and access the aforementioned data in accordance with its internal information security policies. Such data will only be processed within the scope of the purposes stated above. The Company will define reasonable retention periods for different categories of data, and upon expiration of the applicable retention period, such data shall be deleted or anonymized, unless otherwise required by law.

第 12 條 客訴方式 Complaint Mechanism

  1. 使用者就本服務爭議,得以第一條申訴(客服)電子郵箱與本公司取得聯繫。

    If the User has any dispute concerning the Services, they may contact the Company via the customer service email address provided in Article 1 of these Terms.

  2. 如反映內容涉及侵害個人權利(包括但不限於姓名權、隱私權、名譽權等),本公司得逕行移除該等內容,並無需事先通知任何人,待本公司確認該等爭議解決後,依狀況決定是否恢復該內容。

    If the complaint concerns an infringement of personal rights (including but not limited to the right to a name, privacy, or reputation), the Company may remove the relevant content without prior notice to any party. After the dispute is resolved, the Company shall determine at its discretion whether to restore the content.

  3. 本公司保有最終審核及處置權,並無義務提供使用者完整審核程序細節,如使用者對本公司處置有任何異議,得依相關規定逕向主管機關進行申訴。

    The Company reserves the final right of review and decision-making. It is under no obligation to disclose full details of the review process to the User. If the User disagrees with the Company’s handling of the matter, they may file a complaint with the competent authority in accordance with applicable regulations.

  4. 使用者理解並同意,如有主管機關依法進行調查,本公司將依法配合,並就調查事項提供必要資訊(包括但不限於帳號識別資訊、使用紀錄、IP 位置等),無須另行取得同意。

    The User understands and agrees that, if an investigation is initiated by a competent authority in accordance with the law, the Company will cooperate fully and provide necessary information related to the investigation (including but not limited to account identification details, usage records, and IP addresses), without requiring separate consent from the User.

第 13 條 免責聲明 Disclaimer

  1. 本服務係依現況現狀提供您使用,本公司並保留隨時修改各項服務功能之一部或全部之權利。本公司對於本服務不作任何明示、暗示或法定的擔保、主張或聲明,包括但不限於對於品質、效能、無侵權、適售性或特定用途適用性之擔保,或因使用本服務過程、按慣例或行業常規而衍生之擔保。在不影響本服務條款之前提下,且在法律容許的最大限度內,本公司不保證提供本服務、Whoscall APP 或其中所含功能,或該服務、應用程式或功能可被存取、不會中斷、及時提供、安全可靠、正確、完整或無錯誤;且如有瑕疵(如有)會被更正;不保證 Whoscall APP、網頁及/或其伺服器完全沒有任何病毒、蠕蟲、軟體鎖、致死裝置、木馬、路由、陷阱門、定時炸彈或任何其他有害之程式碼、指令、程式或元件。

    The Services are provided to you on an “as-is” and “as-available” basis. The Company reserves the right to modify any part or all of the features of the Services at any time.
    The Company makes no express, implied, or statutory warranties, representations, or guarantees regarding the Services, including but not limited to warranties of quality, performance, non-infringement, merchantability, or fitness for a particular purpose, or any warranties arising from usage, custom, or industry practices.
    To the maximum extent permitted by law and without prejudice to other provisions in these Terms, the Company does not guarantee that the Services, the Whoscall APP, or its features will be accessible, uninterrupted, timely, secure, reliable, accurate, complete, or error-free; or that any defects will be corrected.
    Furthermore, the Company does not warrant that the Whoscall APP, the website, and/or their servers are free of viruses, worms, software locks, kill devices, trojans, routing routines, trap doors, time bombs, or any other harmful codes, scripts, programs, or components.

  2. 如本公司處理您的任何帳戶活動時發生任何錯誤或遲延,本公司有權修正、移除、撤回或刪除受影響之帳戶活動,本公司對於您因此造成之損害均不負賠償責任。

    If any error or delay occurs in the handling of your account activity, the Company reserves the right to correct, remove, reverse, or delete the affected transaction. The Company shall not be liable for any damages or losses you may suffer as a result.

  3. 本公司有權隨時暫時或永久修改或終止本服務(或其任何部分),而無論其通知與否,您同意對於本網站服務所作的任何修改、暫停或終止,本公司對您和任何第三人均無需承擔任何責任。

    The Company may at any time temporarily or permanently modify or terminate the Services (or any portion thereof), with or without notice. You agree that the Company shall not be liable to you or any third party for any modification, suspension, or termination of the Services.

    To the fullest extent permitted by law, you acknowledge and agree that you bear all risks associated with your use of the website and/or the Services and their performance.

第 14 條 責任限制 Limitation of Liability 在法律許可下,除因重大過失或故意行為所致之直接損失外,本公司將不負責任何本服務及/或本公司行為所造成之任何損害及/或損失。如本公司對任何使用者需負任何賠償責任,本公司對單一使用者之賠償責任應以對該使用者所收取之費用(如有)為上限。

To the extent permitted by law, the Company shall not be liable for any damages and/or losses arising out of or in connection with the Services and/or the conduct of the Company, except for direct damages resulting from the Company’s willful misconduct or gross negligence. If the Company is found liable to any User, its total liability to such User shall be limited to the amount of fees (if any) actually paid by that User to the Company.

第 15 條 資料蒐集、利用 Data Collection and Use

  1. 本公司蒐集、處理及利用個人資料,應依個人資料保護法等相關法令規定辦理。但其他法律或主管機關另有規定者,不在此限。

    The Company shall collect, process, and use personal data in accordance with the Personal Data Protection Act and other applicable laws and regulations. However, where other laws or competent authorities provide otherwise, such provisions shall prevail.

  2. 本公司對於使用者涉及個人資料之蒐集、處理及利用等告知事項,請見本服務之隱私權保護政策。

    For matters regarding the collection, processing, and use of personal data related to Users, please refer to the Privacy Policy of the Services.

  3. Whoscall APP 部分服務內容(如號碼標註、風險提示、搜尋建議等)係由註冊用戶在使用過程中基於實際接觸情形所主動提供或標註,屬於使用者互動所產生之回饋性資料,該等資料可能涉及非註冊用戶之資訊(如電話號碼所屬人、來電者、發送訊息之號碼等),但本公司不會基於該等資料建立非用戶之個人資料檔案,亦不作為行銷、推播或聯繫該非用戶之依據。本公司蒐集、處理與展示此類回饋性資料,將用於提升服務品質、防制詐騙及相關業務之開發優化、改善資訊透明度與強化來電識別體驗。相關處理均依據資料最小化原則、匿名化方式及合法正當目的執行。非用戶如對其資料內容有異議,得依本公司隱私權保護政策公告程序提出申訴,本公司保留完整審查及處置權。

    Certain service features of the Whoscall App (such as number tagging, risk alerts, and search suggestions) are provided or tagged voluntarily by registered users based on their actual experiences during use. These are user-generated feedback data and may involve information related to non-registered users (such as the owner of a phone number, caller identity, or message sender).
    The Company will not establish personal data profiles of non-users based on such data, nor will such data be used for marketing, notifications, or contacting such non-users.
    The collection, processing, and display of such feedback data are solely for the purposes of improving service quality, fraud prevention, business development and optimization, enhancing information transparency, and strengthening caller identification experience. All related processing is carried out based on the principles of data minimization, anonymization, and lawful purposes.
    If a non-user objects to any content relating to them, they may submit a complaint in accordance with the procedure published in the Company’s Privacy Policy. The Company reserves the full right to review and determine the outcome.

第 16 條 契約終止 Termination of Contract

  1. 使用者得依約定方式隨時通知本公司終止就本服務與本公司締結之契約關係。

    The User may terminate the contractual relationship with the Company regarding the Services at any time by notifying the Company in the agreed manner.

  2. 除本服務條款另有約定,本公司對使用者終止提供本服務時,須於終止日三十日前以書面、電子郵件或雙方約定方式通知使用者。

    Unless otherwise provided in these Terms of Service, the Company shall notify the User at least thirty (30) days prior to the termination of the Services by written notice, email, or other method agreed upon by both parties.

  3. 除經主管機關同意外,本公司不得將本服務及因本服務所生之權利義務關係移轉予第三人。

    Unless approved by the competent authority, the Company shall not transfer the Services or any rights and obligations arising therefrom to any third party.

第 17 條 契約基本權利義務 Fundamental Rights and Obligations Under the Agreement

  1. 本服務條款如有修改或增刪,本公司應於網頁明顯處公告,並以電子郵件或其他約定之方式通知使用者;如七日內無不為異議者,則推定承認該修改或增刪條款。

    If these Terms of Service are amended or supplemented, the Company shall post a notice in a prominent place on the website and notify the User via email or other agreed method. If no objection is raised within seven (7) days, the User shall be deemed to have accepted such amendments or supplements.

  2. 本服務所稱之相關規範包含相關網頁或操作介面上所載之處理流程、說明、約定、使用辦法、注意事項及限制等,均視為本服務條款一部分。

    The term “related rules” as used in the Services includes any procedures, instructions, agreements, usage guidelines, notices, or restrictions described on relevant webpages or user interfaces, all of which shall be deemed an integral part of these Terms of Service.

  3. 本服務條款未盡事宜,應依相關法規或主管機關函釋辦理。

    Matters not provided for in these Terms of Service shall be handled in accordance with applicable laws and regulations or the interpretations issued by competent authorities.

第 18 條 通知 Notices

  1. 就本服務條款及任何其他協議、告示或其他關於您使用帳戶或服務的通知,您同意本公司使用電子方式通知您(包括但不限於電子郵件(送達使用者申請本服務時所提供之通訊資料)、於本網站或合作網站上公布、無線通訊裝置通知)。您同意本公司以電子方式發出前述通知之日即視為通知已送達。如因資訊傳輸等原因導致您未在前述通知發出當日收到該等通知者,本公司不負擔任何責任。

    With respect to these Terms of Service and any other agreements, notices, or information concerning your use of your account or the Services, you agree that the Company may provide such notices electronically (including but not limited to email sent to the contact information you provided when applying for the Services, publication on the website or partner websites, or notifications through wireless communication devices). You agree that the date on which the Company issues such electronic notice shall be deemed the date of delivery. The Company shall not be held liable if you do not actually receive the notice on that date due to transmission or other technical issues.

  2. 使用者通訊資料如有變更,應立即於本服務網頁或以雙方約定之方式通知本公司。使用者如未依約定方式通知變更通訊資料時,本公司依原留存之通訊資料所為之通知,推定已為送達。

    If there is any change to your contact information, you shall promptly notify the Company via the Services website or by other agreed-upon means. If you fail to notify the Company of such changes in the agreed manner, any notice sent by the Company to your previously provided contact information shall be deemed duly delivered.

第 19 條 委託他人作業 Outsourcing of Operations

  1. 使用者同意本公司得依相關法令規定,將本服務之一部,委託第三人(機構)處理。

    The User agrees that the Company may, in accordance with applicable laws and regulations, outsource part of the Services to a third party (organization) for processing.

  2. 本公司依前項規定委託他人處理業務時,應督促並確保該等資料利用人遵照相關法令之保密規定,不得將該等有關資料洩漏予受託人以外之第三人。

    When the Company outsources operations pursuant to the preceding paragraph, it shall supervise and ensure that the data processor complies with applicable confidentiality obligations and does not disclose such data to any party other than the entrusted processor.

  3. 受本公司委託之處理資料利用人,違反個人資料保護法規定,致個人資料遭不法蒐集、處理、利用或其他侵害使用者權利者,使用者得向本公司及受本公司委託之處理資料利用人請求連帶賠償。

    If a data processor entrusted by the Company violates the Personal Data Protection Act, resulting in the unlawful collection, processing, or use of personal data or any other infringement of the User’s rights, the User may claim joint and several compensation from both the Company and the entrusted processor.

第 20 條 準據法 Governing Law

因本服務所生之爭議,如因此涉訟,雙方同意以臺灣臺北地方法院為第一審管轄法院。但不得排除消費者保護法第四十七條或民事訴訟法第二十八條第二項、第四百三十六條之九規定小額訴訟管轄法院之適用。

Any dispute arising from the Services shall be submitted to the Taipei District Court in Taiwan as the court of first instance. However, this shall not preclude the applicability of the jurisdiction provisions under Article 47 of the Consumer Protection Act or Article 28, Paragraph 2, and Article 436-9 of the Code of Civil Procedure regarding small claims proceedings.
